Nova Wigs, property of the sole proprietorship Nova Wigs, registered with the Lyon Trade and Companies Register (France) under number Lyon A 828 338 236, with its registered office at 11 cours docteur longs, 69003 Lyon, identified under the intra-community VAT number FR44828338236 (hereinafter "Nova Wigs"), operates a website accessible at the address https://www.nova-wigs.com/ (hereinafter the "Website").
These General Terms and Conditions of Sale (hereinafter the "T&Cs") govern the commercial relations between Nova Wigs and any natural or legal person placing an order on the Website (hereinafter "the Customer").
It is specified that consumer protection regulations derived from EU consumer law included in these T&Cs do not apply to orders placed by legal entities or natural persons placing an order on the Website as part of their professional, commercial, craft, or industrial activity.
I. PURPOSE OF THE T&Cs AND VERSION IN FORCE
1.1. The purpose of these T&Cs is to define the conditions under which Customers can access the Website, use it, and place orders with Nova Wigs, including all resulting rights and obligations. They apply to any order placed by Customers through the Website, and exclusively to this method of ordering. If applicable, the T&Cs shall prevail over any other contradictory document not expressly accepted by mutual agreement by the Customer and Nova Wigs as deviating from the T&Cs.
1.2. All Customers who access the Website agree to respect, without restriction or reservation, the T&Cs, which are accessible at any time on the website and also brought to their attention before the confirmation of their order.
1.3. Nova Wigs may modify these T&Cs, in particular to take into account any legal, jurisprudential, editorial, and/or technical developments within the European Union. Modifications to the T&Cs will be applicable as soon as they are posted online on the Website. From one order to another, Nova Wigs invites the Customer to carefully reread the T&Cs appearing on the Website, the update dates being indicated. In the event of a modification, the applicable T&Cs are those in force on the date the order is placed by the Customer.
II. PRODUCTS
2.1. The products offered for sale by Nova Wigs are those available online on the date of the order by the Customer, within the limit of available stocks. The Customer will be informed of the unavailability of a product at the time of placing the order. In the event that the product ordered by the Customer is nevertheless no longer available after the order has been placed, Nova Wigs will contact the Customer as soon as possible to allow them either to cancel the order and receive a refund for the product concerned, or, if a return to stock of the product is possible, to postpone the delivery date after replenishment of said product, or to substitute the unavailable product with one of equivalent value. In the event of cancellation and a request for a refund, the latter is carried out within 10 (ten) days following the date of placement of the related order, onto the bank card used when placing the order.
2.2. Each product sold on the Website is subject to a presentation summarizing its main characteristics as well as a detailed presentation (including in particular the composition of each product) accessible by clicking on the product concerned and scrolling down the page.
2.3. Product prices are indicated in euros, all taxes included; they take into account any reductions as well as the VAT rate in force on the day of the order in the Customer's country of delivery (in accordance with EU OSS VAT rules). The cost of delivery of the products is not included in the price of the products and is invoiced additionally to the Customer. Its amount is specified to them prior to the definitive validation of the order. The applicable prices are those displayed online on the Website at the time of validation of the order by the Customer.
III. ORDERS
3.1. The Customer can browse the Website and learn about the different products offered for sale without obligation to purchase and without obligation to register, unless certain promotional offers or reductions are reserved for account holders on the Website and it is necessary to log in using their username and password to view them.
3.2. Any person wishing to place an order on the Website must be at least 18 years old on the day the order is placed. To place an order on the Website, the Customer must create an account on the Website. Therefore, at the time of placing an order, they must either log in with their username and password or fill out the account creation form. To create an account, the Customer must provide the following information: title, last name, first name, date of birth, full postal details, telephone number, valid email address, and a password. The Customer is required to provide complete, up-to-date, and accurate information, failing which Nova Wigs cannot be held liable in this respect. The Customer is informed that some of the information requested is mandatory for the proper execution of the order they have placed, which they expressly acknowledge. In the event of a forgotten password, the Customer can obtain a new one by clicking on the "Forgotten Password" link. The Customer will receive an email inviting them to choose a new one under the conditions and modalities that will be specified to them. The Customer acknowledges that the combined entry of their username (email address) and password constitutes proof of their identity and binds them for any order placed through them. The Customer is responsible for keeping their password secure, and it is recommended not to disclose it to third parties. The Customer agrees to inform Nova Wigs as soon as possible of any use of their username and password by a third party not authorized by the Customer.
3.3. The Customer's order takes place in two steps: the Customer chooses and selects the product(s) they wish to buy by clicking on "Add to cart", having previously viewed the product sheet of the products concerned and verified that they suit them. Once their selection has been made, they can continue their selection by clicking on "Continue shopping", view a full summary of their order by clicking on "My cart", or finalize their order by clicking on "Checkout". If they choose to finalize their order, the Customer must then decide on the delivery method, the payment method, as well as the billing and delivery addresses. A summary of the order is presented to them (products ordered, quantity and price of products, delivery cost, delivery method, requested delivery date, etc.) before the Customer definitively confirms it by accepting these T&Cs and clicking on "Place order". The total cost, including applicable VAT and delivery, will be clearly indicated to the Customer in euros before the validation of the order. Until the validation of their order, the Customer has a mechanism allowing them to modify or cancel it, in whole or in part, using the "modify your cart" or "modify" functions. Validation by the Customer via payment for the order means that the order is firm and final, subject to contrary provisions below. The order can no longer be modified (quantity, products, requested delivery date and time, etc.) after validation by the Customer. The Customer cannot place an order for a delivery address that is not served by Nova Wigs.
3.4. For deliveries outside the European Union, the prices displayed on our site are indicated exclusive of local taxes, customs duties, and any other potential taxes that may be required by the country of destination. These additional costs, which may be collected upon arrival of the parcel in the delivery country, remain the responsibility of the customer. It is the customer's responsibility to obtain information from the competent local authorities regarding any applicable taxes or duties and to pay them.
3.5. Payment for the Customer's order can be made by bank card (Visa, Mastercard, American Express), or PayPal, via the secure interface provided by the CIC bank. When payment is made by bank card, the Customer must validate the order by entering a security code sent to them by SMS to the number indicated at the time of creating their account, in compliance with EU Strong Customer Authentication (SCA) regulations. In the case of payment by bank card, the Customer must provide the following information: name of the cardholder, card number, expiration date, and the 3 (three) digit cryptogram number (CVV). Payments by other methods of payment than those listed above are not accepted. Orders are taken into consideration by Nova Wigs subject to their payment: in the event of payment by bank card, the payment will be taken into consideration at the time of confirmation issued by the banking institution of the cardholder whose card was used for payment. In the event of a PayPal payment, the payment will be taken into consideration at the time of confirmation by PayPal of sufficient funds in the related account. In the event of an order for an amount greater than one hundred (100) euros, Nova Wigs may require proof of identity as well as a copy of the card used for payment in order to fight against payment method fraud.
3.6. Once the order is validated and payment is made, the Customer receives an order confirmation by email. This email summarizes the characteristics of the order (products ordered, price, requested delivery time, etc.), as well as the options for exercising their right of withdrawal, for products to which it applies. It is recommended that the Customer print and/or keep this order confirmation.
IV. DELIVERY
4.1. The shipping of the Customer's order is carried out after receipt of the full price of the order, including shipping costs.
4.2. The delivery time specified just before the finalization of the order and on the summary of the order runs from the day following that of the validation of their order by the Customer.
4.3. Delivery costs depend on the delivery method chosen by the Customer at the time of placing the order. These are indicated to the Customer at the time of placing their order and are also detailed here. Delivery times are expressed in working days, which mean Monday to Saturday – excluding public holidays. In the event of exceeding the delivery deadline mentioned when placing the order and in the order confirmation - not due to a case of force majeure, the Customer may cancel their order by registered letter with acknowledgment of receipt or equivalent written means addressed to Nova Wigs – Service WEB – 5 avenue Berthelot – 69007 Lyon, France.
Delivery by Colissimo international
Delivery within two (2) working days from Monday to Saturday in mainland France (for European cross-border shipping, delays vary by destination country) from 8 a.m. to 7 p.m. on weekdays and from 8 a.m. to 12 p.m. on Saturday. The Customer agrees to check the conformity of their order at the time of its receipt, as well as the condition of the products. In the event that a person other than the Customer is the recipient of the Products, the Customer must ensure that the recipient concerned checks the conformity and condition of the products upon delivery. In the event of a conformity problem, the customer must contact Customer Service within 3 days following receipt of the package. The order cannot be canceled once the package has been shipped. The Customer will be informed of the shipping date of the order by email or by logging in using the Colissimo reference available in their secure Nova Wigs space. In the event of a delivery failure, the package may, at Colissimo's discretion, potentially be dropped off at a local postal relay point, and the Customer or recipient will be notified.
Delivery by Chronopost / International Express Carriers
The Customer agrees to be present or ensure that the recipient of the order is present at the delivery address indicated at the time of the order, on the dates and times indicated by the Customer. If this is not the case, the delivery driver will call them at the number provided by the Customer at the time of registration on the Website. Nova Wigs cannot be held liable in the event of a delivery delay independent of its will. 4.4. In accordance with EU Directive 2011/83/EU on Consumer Rights, Nova Wigs is responsible for the proper execution of the order, including delivery, except in cases of force majeure or fault attributable to the customer. In the event of an order indicated as "delivered" by the carrier but not received by the customer, the customer must report the incident within 48 business hours following the presumed delivery date, in writing (email or contact form). Nova Wigswill then open an investigation with the carrier, which may last up to 30 working days. During this period, no reshipment or refund can be made, unless there is clear proof of a delivery error. In order to proceed with the processing of the claim, the customer must provide:

a sworn statement of non-receipt of the package,
-
and a copy of the official complaint filed with the competent local law enforcement or postal authorities, specifying the tracking number of the package concerned.
These elements are essential to continue the investigation, trigger potential compensation by the carrier, and consider a refund or reshipment. If the investigation concludes that delivery was compliant with the address indicated during the order, and in the absence of proof of fraud or breach by the carrier, Nova Wigs cannot be held liable. The customer is invited to check with neighbors or their building caretaker to see if the package could have been received on their behalf.
V. RIGHT OF WITHDRAWAL
5.1. In accordance with EU Directive 2011/83/EU on Consumer Rights, the Customer has a withdrawal period of fourteen (14) calendar days from the day on which the Customer, or a third party indicated by the Customer, acquires physical possession of the goods. The Customer does not need to justify any particular reason or pay penalties. Beyond this period of fourteen (14) days, no withdrawal request will be processed. The right of withdrawal can be exercised with Nova Wigs by an unambiguous written statement sent to 5 avenue Berthelot – 69007 Lyon, France, or by means of the model withdrawal form available here. An acknowledgment of receipt of this form will then be sent to them by Nova Wigs.
5.2. In accordance with EU law, the right of withdrawal does not apply to certain goods, including:

(i) supply of goods liable to deteriorate or expire rapidly;

(ii) supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
5.3. For products that can be subject to a right of withdrawal, the Customer must return them to the address Nova Wigs – Service WEB – 5 avenue Berthelot – 69007 Lyon, France, without undue delay and in any event not later than fourteen (14) days from the day on which they communicate their withdrawal. The direct costs of returning the products are the responsibility of the Customer. Products must be returned in their original packaging, unsealed, unopened, intact, and ready to be put back on the market. In the event of exercising the right of withdrawal, the price of the returned product(s) will be refunded. Standard delivery costs of the initial order will be refunded (excluding additional costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered by us).
5.4. Nova Wigs will refund the Customer using the same method of payment as that used to place the order, at the latest within fourteen (14) days following the day on which we are informed of the consumer's decision to withdraw. Nova Wigs may withhold the reimbursement until we have received the goods back or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest.
VI. LEGAL WARRANTIES AND CONFORMITY
In accordance with EU Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods, all products sold through the Website benefit from a legal guarantee of conformity and protection against hidden defects under applicable laws.
1. Legal Guarantee of Conformity

Duration: Under EU law, the consumer benefits from a minimum legal guarantee of two (2) years from the delivery of the goods to remedy any lack of conformity.

Presumption of Defect: Any lack of conformity which becomes apparent within two (2) years (or the period specified by the consumer's country of residence, if longer) from the time when the goods were delivered shall be presumed to have existed at the time of delivery, unless the seller proves otherwise or this presumption is incompatible with the nature of the goods.

Remedies: In the event of a lack of conformity, the consumer is entitled to have the goods brought into conformity free of charge, either by repair or replacement, or to receive a proportionate reduction of the price, or to terminate the contract, under the conditions laid down by EU Directive 2019/771.
2. Hidden Defects
The consumer may also implement the warranty against hidden defects in accordance with applicable civil laws. In this case, they can choose between the cancellation of the sale or a reduction of the sale price.
VII. USE OF THE PLATFORM - OBLIGATIONS OF CUSTOMERS
7.1. Upon online registration on the site, the customer agrees to provide true, accurate, up-to-date, and complete information regarding their identity and all details they provide. The use of pseudonyms is strictly prohibited. The Customer agrees to immediately update the data they communicated during registration in the event of a modification. Identity theft and fraud are subject to prosecution under applicable criminal laws. A customer who notes one or more facts constituting identity theft must immediately inform Nova Wigs via the contact form. A customer can open only one account on the site, which is limited to their personal use only.
7.2. The customer is solely responsible for the use made of their account as well as the protection of their username and passwords. Any identity theft, loss, misappropriation, or unauthorized use of a customer's identifiers and/or account and their consequences fall under the sole responsibility of that customer. In all cases mentioned above, the customer is required to notify Nova Wigs, without delay, via the contact form, to allow Nova Wigs to take measures to remedy the situation. The customer is fully informed of the risks related to the loss or theft of their username and password, the hacking of their equipment, or any other fraudulent act allowing unauthorized use of their account.
7.3. In the event of knowledge of manifestly illegal acts by a Customer within the framework of their activity on the Website or in connection with the latter and/or in the event of violation of the stipulations of these T&Cs and/or of any legal or regulatory obligations, Nova Wigs may, immediately, without notice or compensation, delete or suspend the customer's account.
7.4. Customers acknowledge that their access to the Website may be conditioned on certain technical requirements (high-speed internet connection and a recent browser). Failing this, operational difficulties of the Website cannot engage the liability of Nova Wigs.
VIII. PROTECTION OF PRIVACY AND PERSONAL DATA (GDPR COMPLIANCE)
8.1. In accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679, Customers must create an account on the Website and provide certain personal data to complete an order, including notably their title, last name and first name, email address, telephone number, etc.
8.2. The personal data of Customers is subject to automated processing by Nova Wigs, which acts as the Data Controller, for the purposes of managing and administering the commercial relationship, fulfilling orders, shipping, and processing legitimate marketing.
8.3. Data Practices and Rights:

Mandatory Data: Data marked with an asterisk is strictly necessary for the performance of the contract (delivery and billing).

Retention: Data collected is kept for a period of three (3) years from the end of the commercial relationship or the last contact from the Customer, after which it may be archived to comply with legal and tax limitation periods.

Customer Rights: Under the GDPR, Customers have the right to request access, rectification, erasure (right to be forgotten), restriction of processing, data portability, as well as the right to object to processing. These rights can be exercised by sending an email to: hello@nova-wigs.com.

Customers also have the right to lodge a complaint with their national Data Protection Authority (such as the CNIL in France or the equivalent authority in their EU country of residence).
8.4. Cookies: Nova Wigs complies with the EU ePrivacy Directive. The prior explicit consent of the Customer must be collected via a cookie banner before setting up any non-essential cookies. Cookies used for tracking or marketing will be kept for a maximum of 13 months. The Customer can modify their preferences or reject cookies at any time through their browser settings or the on-site privacy panel.
IX. INTELLECTUAL PROPERTY
9.1. Without this list being exhaustive, the trademarks "Nova Wigs" as well as its derivatives, logos, graphic charter, layout, information, presentation, and content of the Website, as well as corporate names, trade names, signs, and domain names, constitute elements protectable under European and international intellectual property laws, whether by copyright, trademark law, or any other proprietary right. Nova Wigs is the owner and/or operator thereof.
The systems, software, structures, infrastructures, databases, and content of any nature (texts, images, visuals, music, logos, trademarks, databases, etc.) operated by Nova Wigs on the Website are also protected by all intellectual property rights or database producer rights in force. Any reuse, copying, and more generally, any act of reproduction, representation, distribution, and use of any of these elements, in whole or in part, without the authorization of Nova Wigsis strictly prohibited and may be subject to legal proceedings.
Any reproduction or representation, total or partial, of the Website or the elements composing it, such as trademarks, logos, graphic charter, layout, information, photographs, presentation, and content of the Website, without this list being limiting, is prohibited.
9.2. Registration on the Website does not imply any transfer of intellectual property rights to the benefit of the Customer, who is solely responsible in the event of a breach of the aforementioned provisions.
9.3. The Website may contain hypertext links leading to third-party websites, managed by third parties, over which Nova Wigs exercises no control. Consequently, Nova Wigs declines all responsibility for the content of these third-party sites, the use that could be made of them, as well as the content to which these third-party sites may refer, for which the third party concerned is solely responsible.
X. ACCOUNT DELETION
The Customer may suspend or close their account at any time, for any reason whatsoever, by sending a request to Nova Wigs by email to the address hello@nova-wigs.com. This deletion will take effect after the expiration of the cancellation and withdrawal periods relating to the latest order placed by the Customer.
In the event of account deletion by the Customer, the latter will no longer be able to place orders via the Website, unless they create a new account.
XI. NON-WAIVER – ENTIRETY – PROOF OF TRANSACTIONS
11.1. The fact that Nova Wigs does not take advantage of a stipulation of the T&Cs or of a failure or breach by the Customer in respect of any of their contractual or legal obligations shall not be interpreted as a waiver of the right to take advantage of this stipulation, failure, or breach.
11.2. In the event that a provision of the T&Cs is declared null or invalid under EU law or the laws of the member state of destination, this provision will be considered unwritten, and all other provisions of the T&Cs will continue to apply.
11.3. Unless proven otherwise, the data recorded by Nova Wigs constitutes proof of all transactions.
XII. CUSTOMER RELATIONS SERVICE

XIII. APPLICABLE LAW AND COMPETENT JURISDICTION
These T&Cs are governed by French law. However, in accordance with EU Regulation No 593/2008 (Rome I), this choice of law does not deprive consumers of the protection afforded to them by mandatory provisions of the law of their country of habitual residence.
In the event of a dispute relating to an order, the customer must first contact Nova Wigs in order to find an amicable solution, via the contact form.
Furthermore, in accordance with Article 14 of EU Regulation No 524/2013, the European Commission has set up an Online Dispute Resolution (ODR) platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. Failing an amicable outcome and regardless of the origin of the conflict—whether it concerns the formation, execution, interpretation, validity, termination, or cancellation of these T&Cs, including conservatory procedures, emergency procedures, summary proceedings, third-party appeals, petitions, or plurality of defendants—the dispute will be settled in accordance with EU jurisdictional rules (EU Regulation No 1215/2012 / Brussels I bis). Consumers may bring legal proceedings either in the courts of France (where the seller is located) or in the courts of the place where the consumer is domiciled.
It is specified that the deadlines for taking legal action are not interrupted during the time an amicable solution is being sought or mediation is requested by the Customer.
